These Terms of Service govern your use of thirtybirds.com.au (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms.

Thirty Birds Records is a specialist vinyl record retailer trading as Thirty Birds (ABN 30 764 001 518), based in Victoria, Australia. You can reach us at hello@thirtybirds.com.au.

Products

Most items in our catalogue are secondhand and sold as individual, often one-off copies. Where an item is used, its condition is graded according to the Discogs Goldmine Standard and described in the product listing, condition and grading form part of that item's description. We make reasonable efforts to ensure listing information (artist, title, label, condition, images) is accurate, but as physical secondhand goods, minor variation between listing and item is possible.

We reserve the right to limit quantities, refuse or cancel an order (for example, if an item is sold out, mispriced, or a listing error is identified), and to correct pricing or listing errors. If we cancel a paid order, you will receive a full refund.

Orders and payment

Orders are accepted once payment is received in full via PayPal. Placing an order is an offer to purchase, we're not obligated to accept it until payment has cleared and the order is confirmed. Prices are listed in Australian Dollars (AUD) and include GST where applicable.

Returns and your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure, and to compensation for other reasonably foreseeable loss or damage; you're also entitled to have goods repaired or replaced if they fail to be of acceptable quality without amounting to a major failure. Nothing in these Terms limits or excludes those rights.

Intellectual property

The Site, including its design, text, graphics, logos, and the Thirty Birds name and welcome swallow logo, is owned by us or used under licence and is protected by copyright and trade mark law. You may not reproduce, distribute, or use our branding or content without our written permission. Product images and information sourced from Discogs or record labels remain the property of their respective owners.

Acceptable use

You agree not to use the Site for any unlawful purpose, to attempt to disrupt or interfere with its operation, or to use automated means (bots, scrapers) to access or extract content from the Site without our permission.

Limitation of liability

To the extent permitted by law, and subject always to your rights under the Australian Consumer Law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Site or purchase of products from us. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the ACL or other applicable law that cannot lawfully be excluded.

Changes to these Terms

We may update these Terms from time to time. Changes take effect once posted on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
