Your rights under Australian Consumer Law

Nothing in this policy limits or excludes your rights under the Australian Consumer Law (ACL). Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

This means that if an item you receive is faulty, significantly different from how it was described, or not fit for the purpose a record is normally used for, you are entitled to a remedy (repair, replacement, or refund, at our discretion for a minor failure, or your choice for a major failure) regardless of any timeframe stated below. The timeframes in this policy are in addition to, not instead of, your statutory rights.

Grading and description standard

We grade all records according to the Discogs Goldmine Standard. Media condition is assessed primarily by listening to representative portions of each record rather than by visual inspection alone, unless the item is factory sealed. Grades and any noted condition issues (surface marks, sleeve wear, etc.) form part of the item's description for the purposes of your consumer guarantees — if an item arrives in materially worse condition than graded, this is treated as not matching its description.

If an item arrives faulty, damaged, or not as described

Contact us at hello@thirtybirds.com.au within 7 days of delivery, including your order number and a description (and photos, where relevant) of the issue. We'll assess the issue and offer a repair, replacement, or refund as appropriate under the ACL. Where the item is a major failure (e.g. warped, unplayable, or substantially different from its listed grade), the choice of remedy is yours.

We may ask you to return the item before a refund or replacement is issued. Where the fault is ours (incorrect grading, damage in transit, or an item not as described), we will cover the cost of return shipping. We will not require you to return the item at your own cost where doing so would be unreasonable given the fault.

Contacting us after the 7-day window does not forfeit your statutory rights under the ACL — it only affects your ability to rely on the additional timeframe in this policy. Get in touch regardless and we'll work through it with you.

Change of mind

We don't offer refunds or exchanges for change of mind. As secondhand and specialist vinyl, most items in our catalogue are one-off copies, so please check the listing details, grading, and any photos carefully before purchasing. Shipping and loss/damage in transit

All orders are shipped with tracking. If your order is lost or arrives damaged in transit, contact us and we will lodge a claim and arrange a replacement or refund as appropriate — this is separate from, and does not reduce, your rights under the ACL for items that are faulty or not as described.

How refunds are processed

We process approved refunds through PayPal as soon as a remedy is agreed. If your payment was funded from a PayPal balance, the refund is usually instant. If it was funded via a linked card or bank account, PayPal issues the refund immediately on our end, but the time it takes to reach you depends on your card issuer or bank — this can take anywhere from a few business days up to 30 days and is outside our control. We do not offer store credit as a substitute for a refund you're entitled to under the ACL, though we're happy to offer it as an option where you'd prefer it.
